
Estate planning is, without a doubt, the most avoided and postponed legal task that we all face. Everyone needs an estate plan so that the fruits of your and your spouse’s life’s labor can go to those you love. Yet, we all put it off, year after year. Why? The process of creating a simple estate plan – a will or a simple trust - is largely painless and not particularly expensive nor time consuming. We avoid it because it forces us to deal with our own mortality - the fact that our time is limited.

The problem with avoiding estate planning is that you may never get around to it; or when you do, you may be unable to clearly think through the issues that would have been easier to deal with when you were younger and healthier. Most of us, when we die, will leave behind a spouse and children and grand children. If we fail to make those decisions prior to our death, others will be forced to make those decisions for us. These post-death decisions can be difficult and controversial and often can lead to a great deal of family strife and disaffection.
Your unwillingness to properly deal with these issues well before your death may well result in a great deal of unnecessary family conflict and unhappiness which may make your spouse’s life much more difficult than it would have been if the two of you had created an estate plan in advance. It also may create taxation issues and expenses that were avoidable if you had planned ahead.
